Landgericht Münster (District Court Münster), Decision date: 27th of March 2020, file no.: 021 O 21/20 Protective Brief against an expected motion for an injunction

In this case, the Landgericht Münster (District Court Münster) has rejected the motion for an injunction against our client.

Due to previous communication, we anticipated that the opponent would file for such a motion in court.

We preemptively deposited a protective brief, to state our legal opinion on the issue, in case a motion was filed, in order to avert that the court sustains a potential motion.

And indeed, shortly thereafter, the opposing party filed for an injunction.

The court then considered our protective brief and as a result informed the opposing party, that there were no grounds for their request. Subsequently, our opponents withdrew their motion and were sentenced to bear the costs of the proceedings.

Landgericht Münster (District Court Münster), Decision date: 25th of March 2020, file no.: 12 O 81/20 Preemptive prohibitory injunction

In this case, there were clues that the opposing party was about to commit acts in violation of competition law, but we could not yet prove this. Therefore, we prepared a detailed preemptive prohibitory injunction.

Following the motion of our client, the Landgericht Münster (District Court Münster) granted a prohibitory junction against the opposing party, that they complied with. Thus, we could effectively prevent illegal acts.

Landgericht Bochum (District Court Bochum), Decision date: 11th of March 2020, file no.: 8 O 68/20 Copyright infringement of images

In this case, we represented a company, whose images protected by copyright were illegally distributed.

The Landgericht Bochum (District Court Bochum) granted an injunction against the company that violated our client’s rights and banned the further use of the images.

Landgericht Kleve (District Court Kleve), Decision date: 9th of March 2020, file no.: 23 O 4/20 Prohibitory injunction because of damaging accusations

Our client’s company was prompted to pay alleged claims by our opponent. The opponent had also threatened to inform customers and the bank of our client about the alleged outstanding debt.

We not only successfully defended our client against the claims, but also proactively initiated a prohibitory injunction that forbade our opponents to contact any customers or the bank.

Once more, we could prevent lengthy litigation by taking swift action.

Landgericht Münster (District Court Münster), Decision date: 12th of February 2020, file no.: 29 O 121/19 Repeal of the Enforcement against property of our client

The Landgericht Münster (District Court Münster) has reversed an enforcement against protective rights of our clients, which it originally had granted. In the oral hearing we convinced the court that the opposing party could neither demonstrate a claim, nor the necessary grounds for protection.

The opponents appeal against this decision was dismissed by the Oberlandesgericht Hamm (Higher Regional Court Hamm) in a decision on the 8th of June in 2020.

Landgericht Bielefeld (District Court Bielefeld), Decision date: 28th of January 2020, file no.: 4 O 15/20 Copyright infringement of images

In this case, we defended a company against the illegal distribution of images by a competitor, who used these for marketing purposes.

We achieved an immediate injunction against the misuse of the images.

Landgericht Münster (District Court Münster), Decision date: 23rd of January 2020, file no.: 22 O 122/19 Illegal use of company property

In this case, we successfully represented a company against former employees, who had misused company property to form a new company in violation of competition law. We filed a prohibitory injunction against their illegal use of company assets.

Our injunction was granted by the court in accordance with our motion.

The opposing party withdrew their appeal, after the Oberlandesgericht Hamm (Higher Regional Court Hamm) pointed out that their defense had no prospect for success.

Landgericht Kleve (District Court Kleve), Decision date: 21st of January 2020, file no.: 7 O 1/20 Unfair acts of representation

In this case, a former business partner had closed contracts, without consulting the affected parties. Regardless of whether the contracts could even be closed with regards to a lack of power of representation, we successfully filed an injunction against the formation of contracts in our client’s name.

This demonstrates once more, that especially in cases of the violation of competition law, quick action is sensible.

Landgericht Dortmund (District Court Dortmund), Decision date: 30th of December 2019, file no.: 16 O 98/19 Announcement of an illegal stop of deliveries

The purpose of these antitrust proceedings was to represent our client’s business against the intended stop of deliveries by its sole supplier. This stop of deliveries would have caused considerable damage for the company.

Therefore, we filed an injunction that would require the supplier to continue their deliveries.

In an expedited process, the court granted the injunction to prevent the supplier from implementing the announced stop of deliveries.

Landgericht Dortmund (District Court Dortmund), Decision date: 21st of November 2019, file no.: 2 O 314/19 Undue influence on customers

In this case, we defended our client against false accusations by an opponent that were in violation of the competition law.

These statements were used to manipulate our client’s customers. Therefore, we pursued an injunction against the opposing party.

The court prohibited the accusations and granted the injunction, which allowed for quick protection against further illegal statements.

Oberlandesgericht Düsseldorf (Higher Regional Court Düsseldorf), Decision date: 21st of November 2019, file no.: I-20 U 120/18

This case was based on a clear (but unintentional) infringement of trademark rights of a major fashion company. A written warning was issued. As a result, there was a threat of extensive trademark claims. As the infringement was evident, the defense strategy was to avert that the opposing party would be able to sue and to diminish the extent of the infringement.

Nevertheless, the opposing party sued. Regrettably, the court was not convinced and our client was unsuccessful.

Arbeitsgericht Rheine (Labour Court Rheine), Decision date:13th of November 2019, file no.: 3 GA 29/19 Injunction against former employees due to data misuse

In this case, we achieved an injunction for a company against former employees, who had tapped into company data to establish a competing business and thereby manipulated the affected customers.

The court decided in accordance with our motion for a prohibitory injunction against the illegal accessing of customer data.

The opponent’s appeal was rejected by the Landesarbeitsgericht Hamm (Regional Labour Court Hamm) on the 12th of March 2020, file no.: 8 SA 61/19

Oberlandesgericht Bamberg (Higher Regional Court Bamberg), Decision date: 6th of May 2019, file no.: 4 U 31-18

In this legal dispute, our client was sued on a contractual basis. Parallel to our statement of defense, we were advised to pursue an offensive strategy, by suing for damages by means of a countercharge, on the basis of the fact that our client had been delivered goods that were in violation of third-party rights and in consequence affected by a legal defect.

Both, the Landgericht Würzburg (District Court Würzburg) as the first legal instance and the OLG Bamberg (Higher Regional court Bamberg) evaluated aspects of competition law and came to the conclusion of an illegal imitation of the products in question. As a result, we were successful in achieving damages.

The opponent later accepted their defeat at the Bundesgerichtshof (Federal Court of Justice).

Oberlandesgericht Düsseldorf (Higher Regional Court Düsseldorf), Decision date: 4th of April 2019, file no.: I – 2 U 41/18 Interest of compatibility as exclusion of anticompetitive action

In this case, we were able to convince the court that the identical replica of a product does not necessarily mean that the distribution of such a product is a breach of §4 No.3 UWG (Act against unfair competition).

After the lower court had found for a violation of competition law and had served our client with a prohibitory injunction as well as ordered full disclosure and the payment of damages, we took over the case and were successfully able to argue in the appeal proceedings that the replica was not anticompetitive, because buyers need to be able to purchase spare parts and expansion products from competitors.

Due to the unique circumstances of the case, our client could not be expected to change the aesthetics of the product. This would only have been possible, had the original manufacturer acquired property rights, such as design rights, which he had not done.

Therefore, the lower courts decision was overturned and the judgement against our client completely reversed, the opponent’s lawsuit was dismissed, and they were ordered to pay the costs of the proceedings.
